ORDER BELOW BAIL APPLICATION (EXH.2)
1. Perused record. Heard both the sides.
2. This short hand written application is filed under Section 437 of
Code of Criminal Procedure for bail, stating that accused is in custody
since long, he is innocent and falsely implicated, he is not required for
further investigation, he is permanent resident of Mumbai, having no
criminal antecedents.
3. Ld. A.P.P. objected to it stating that amount of cheating involved is
above Rs.20 lacs. Accusations are well founded. There is possibility of
absconding and tampering with prosecution evidence.
4. The record of investigation/charge sheet clearly reflects the
involvement of the accused in the alleged acts of cheating. If this fact
weighed with the reasons assigned in the bail application it can be said
that no justifiable reason appears in it which will tilt balance in favour of
applicant to consider his prayer for bail. Allegations are serious. Other
accused persons are not yet arrested. Though investigation is over for
want of sufficient reasons, application is not tenable. Hence, following
order -
ORDER
Application is rejected.
