ORDER BELOW EXH. 1
1] The applicant Priya Dubey is praying for direction to
respondent to register the birth of her daughter Jivanshi Dubey.
2] The applicant submitted that, her daughter was born on
14.08.2019 at Saisanjivani Hospital, Santacruz (E). Due to ignorance,
entry regarding her birth was not taken within one year from the
birth. The applicant submitted that, birth certificate is required for
school admission purpose. Hence, the present application is filed.
3] The applicant produced on record copies of Discharge
Card, medical documents and Aadhar Card. The application is
supported by Affidavit. The reply of the respondent is annexed with
report of medical officer of health. Respondent recommended
registration of birth. Report was also called from Saisanjivani hospital.
It is reported that the applicant delivered a female child on
14.08.2019 at their hospital. The report submitted by the said
hospital confirms admission of the applicant and delivery of female
child on 14.08.2019. It shows that the child was born at the said
hospital on the date mentioned in the application. The applicant has
substantiated her version. Thus, there is no hurdle to entertain this
application.
4] In view of the aforesaid discussion, there is no hurdle to
grant the relief claimed by the applicant. Hence, the respondent may
be directed to take entry regarding birth of applicant’s daughter.
Hence, the following order.

1. Application is allowed.

2. The respondent is directed to take entry regarding birth of
Jivanshi Sanjeev Dubey as born on 14.08.2019 as per rules
applicable. For that purpose, requisite fee be obtained from
the applicant.
3. Application is accordingly disposed of.
