ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. The present application is filed by a company Logicash Solutions
Private Limited, through its representative Mr. Ajay Bansode, stating that it
is doing a business of providing cash management services to its customers
and in pursuance of it loading cash in various ATMs. One of its employee
committed fraud while loading cash and defrauded it to the huge amount.
Therefore, said company lodged report through one of its office bearers Mr.
Shailesh Sharad Nalawade and offence at C.R. No.148 of 2019 was
registered. The cash of Rs.84 lacs was seized during investigation. It is
lying with the respondent police station. Applicant is in need of it.
Therefore, this application.
3. Neither respondent nor Ld. A.P.P. filed any say. The ownership of the
applicant over cash and its possession with the respondent is not in dispute.
Investigation relating to cash seems to be completed. Applicant is in need
of cash and it remained with investigating agency it will suffer loss. As
such there is no hindrance in allowing the application, hence following
order -
ORDER
a. The respondent is directed to handover the cash of Rs.84,00,000/-
(Rupees Eighty Four Lacs Only) to the authorized representative of the
applicant company Logicash Solutions Private Limited, after verifying his
credentials, on his furnishing indemnity bond of the said amount, on behalf
of company. While handing over cash the respondent shall retain the details
of denominations and numbers of the currency notes and also panchnama
shall be prepared.
c. The copy of this order along with details provided be kept in C.R.
