Cross examination of CW-01- Francis Albert Pereira by advocate Mr.
Nadim Shaikh for the accused :
15. I am studied upto only 8th standard. I am running business
of medical. I do not possess licence of Pharmacy to run medical shop. I
know the accused since year 2018 when she came to me for money. It is
true to say that I met the accused first time in the year 2018. The
accused today present before the court is the same. Accused was
directed to remove the Nakab for identification purpose.
16. I had given Rs.4.5 lakhs in cash to the accused. I have not
shown said amount of loan in my Income tax returns. It is true to say
that my son has also filed a criminal case for dishonour of cheque
against the husband of the accused bearing Registration
No.173/SS/2020. It is true to say that I know the husband of the
accused since year 2004. It is not true to say that there was money
transaction in between me and husband of the accused. It is true to say
that I have written cheque number and details with my hand writing in
receipt Exh.22 produced by me. Now I am shown received Exh.22. It is
true to say that there is no counter signature of myself or accused on
the hand written contents of details of cheque in said receipt. The
signature of witness at Sr.No.1 in receipt Exh.22 is signature of
husband of the accused Mr. Nazir Mohd. Maulana. The signature on
the cheque Exh.23 is also signature of husband of the accused. It is true

to say that I have not filed any document to show that accused is
proprietor of Fahimuddin and Shifa Dry Fish Wholesaller and Retailers.
It is true to say that the name over cheque Exh.23 is written by myself.
I have not obtained any written permission from the accused before
filling my name on the cheque Exh.23. It is not true to say that there is
no seal of bank and signature of authorized officer of the bank on
cheque return memo Exh.24. It is true to say that cheque Exh.23 was
presented for realization in the bank first time on 25.10.2019. It is true
to say that I have not sent demand notice in writing during 25.10.2019
to 25.11.2019 to the accused.
17. It is not true to say that I have filed false case against the
accused to involve her husband. It is not true to say that accused has
not obtained money from me. It is not true to say that accused in not
liable to pay money to me.
