Cross-examination of CW No.01 by Advocate Shri Vishal Jaju for the
accused :-
19. I am appearing in this case on behalf of my company and
not in the individual capacity. The company have passed resolution
in favour of me for filing this complaint and deposing on behalf of the
complainant. The said resolution was passed in the office of the
company. The said resolution was passed in the meeting. It was a
general meeting. It was not annual general meeting. In the said
meeting both the directors of the company were present. I don’t
remember the date and time of the said meeting. The company used
to prepare the minutes of the meeting.
Que: Is it possible for you to produce the minutes of the particular
meeting in which you have authorized to act in the present case?
Ans: That minute book was in my CA’s Office, it was lost and we have
filed a police complaint in that regard.
I can produce the copy of said police complaint.
20. My company is engaging in the business of Export of
Textiles and Investments. This business reflects in the Memorandum

of Association of the company. I don’t remember that whether or not I
have produced the memorandum of association of the company. The
witness volunteers that I can produce it.
21. Our company is investing in shares, lands and property etc.,
we have to check what kinds of investments does this company do
whether it is mentioned in the memorandum of association or not.
Myself and my wife namely Mrs. Sneh Ahuja are the directors of the
complainant company. I have done the investment in the property at
Navi Mumbai.
Que: What kind of investment your company did in the year 2019
and 2020 in the property in the Navi Mumbai vicinity?
Ans: I don’t need to tell you what investments our company did in
Navi Mumbai in the year 2019 and 2020.
22. I met accused in Navi Mumbai, therefore, I know the
accused. He was introduced me as an investor, land trader and
developer by my friend. I did not engage with any business with the
accused in last 10 years. The witness volunteers that except the
transactions mentioned in the complaint. It is true to say that I have
purchased plot in the month of February, 2019 in the area of Navi
Mumbai particularly in Dronagiri from M/s. Murudeshwar
Developers. My son Tarun Ahuja introduced me with the
Murudeshwar Developers. It is not true to say that the accused
introduced me, my company and my son Tarun Ahuja to M/s.
Murudeshwar Developers. Witness volunteers that my son was

introduced to Raju Hardasani who introduced to Murudeshwar
Developers. It is not true to say that the accused is only person who
has communicated on your behalf with the Murudeshwar Developers
for the purchase of the property situated at Dronagiri. I cannot tell
the detail description of the property situated at Dronagiri to the
Court. It is not true to say that I am hiding the details of the
property only because the accused is involved and taken this
company through this deal.
23. I am unable to state the process to transfer of the plots
situated at Dronagiri.
Que: Is it true that the property purchased by you from Murudeshwar
Developers situated at Dronagiri was owned by CIDCO limited?
Ans: It is a lease hold plot.
24. I am not aware about the fact that there is a specific
procedure provided by CIDCO limited for transfer of the plots in
CIDCO area. I have signed the agreement of transfer of the said plot
on behalf of my company. It is true to say that my company has
authorized me to do the entire procedure of transfer of the said plot
to the company from CIDCO. It is true to say that I have signed the
documents which are required for the transfer of the plot in CIDCO. I
have signed the application for the transfer of the plot make to the
CIDCO. I don’t recollect that whether I have signed any other
relevant document in connection with transfer of said plot. I know
what instrument has been made between my company and CIDCO

and Murudeshwar Developers for the transfer of the said plot. That
instrument was nomenclature as “Triparty Agreement”. I cannot
produce the authenticated copy of that triparty agreement. I cannot
tell the reason why I cannot produce the said document.
