for obtaining permission for Fresh Passport
1. Read the application and say given thereon. I have heard both side at
considerable length.
2. By way of this application applicant/accused Haroon Husain Basar prayed for
permission to apply for the fresh passport. He is ready to abide with the condition of order
and to undertake that he will not leave India without permission of this Court.
3. Say of prosecution i.e. APP and I.O. was called. APP filed her say and submitted
that case is pending against accused and there is possibility that accused may abscond and
does not remain present during trial and prayed rejection of application. I.O. also raised
objection on the same ground.
4. Considering rival submission of both sides, it is submitted that, justice would
not be defeated by applying for passport by the accused. The offence levelled against the
accused is bailable. Presence of accused can be secured by imposing stringent conditions.
Therefore, I do not found any reason to reject the application for application of fresh
passport. Hence, I proceed to pass following order :
ORDER
• Application is allowed.
• Permission granted to the applicant for applying passport for a period of 10 years on
condition that, he will not leave India without prior permission of this Court.
