Heard advocate for complainant. Complainant and accused have
settled the dispute amicably out of court at a pre-cognizance stage.
According to him settlement agreement is executed in between
complainant and accused. Complainant is not ready and willing to
proceed with the case. Accordingly, filed application at Exh.10 for
withdrawal of the complaint. Hence, I pass following order.
ORDER
1. Complaint stands dismissed as withdrawn before taking
cognizance of the complaint.
2. In view of Section 43 of Maharashtra Court Fees Act, Court
Fees be refunded as per Rules and stage of proceeding.
3. Order dictated and pronounced in open court.
