ORDER PASSED BELOW EXH.-1
Accused Nos. 1 and 2 present before this court. They are charged with
the offence punishable under section 323, 332, 353, 504 and 506 r/w. 34 of
the Indian Penal Code and Section 37(1), 135 of Maharashtra Police Act,
which are exclusively triable by the Court of Session. Prima facie case made
out. Cognizance taken of the said offences. The copies of the police report
and other documents as specified in the Section 207 of the Code of Criminal
Procedure have been supplied to the accused persons. The case needs to be
committed to the court of Session, for trial, hence following order :
ORDER
1. The case is committed to the Court of Session.
2. Accused are directed to appear before the court of Session on
20.04.2022.
3. The record of the case, the documents and articles, which are to be
produced in evidence, shall be sent to the Court of Session.
4. The Police Station Officer, Police Station Dharavi, be directed to
produce muddemal property in the Court of Session on or before
20.04.2022, positively.
5. The Public Prosecutor shall be notified of the commitment of the case
to the Court of Session.
6. Record and proceedings be sent to the Session Court, Greater Bombay.
