ORDER BELOW EXH.1
Read complaint, verification of complainant. Perused the
documents placed on record. Perused the report under section 202 of
Code of Criminal Procedure filed by police station-B.K.C. dated
10/04/2023.
2. Heard Ld. Advocate Shri Dubey for the complainant.
3. According to the complainant there was divorce petition
fixed for hearing on 28/11/2019. Therefore, the complainant and her
father were present in the court. However, the accused insisted the
complainant to sign agreement for mutual divorce and threatened her
on account of refusal. The accused persons chased the complainant and
her father and on ground floor of Hon’ble Family Court Campus, at
Bandra accused have beaten by fists and kicks.
4. The report under section 202 submitted by police station-
B.K.C. is on record, wherein it appears that, the incident has alleged by
complainant has been taken place and they have registered NC report
1318/2019. Further, the verification statement of complainant (Exh.-
3)categorically made out the case
prima-faciely under sections 323 and
506 r/w.s. 34 of the Indian Penal Code. Therefore, issue process against
accused under sections 323 and 506 r/w.s. 34 of the Indian Penal Code.
