Today matter is fixed for judgment. The procedure to set aside ex-
parte order passed below, Exh.1, dated 22.11.2021, as directed by this
court on 22.08.2023, not followed. The say to main and interim
application filed on record without following proper procedure already
rejected. However, considering the principles of natural justice and in the
interest of fair trial the order dated 22.11.2021, proceeding to ex-parte
against respondent is set aside and say on main and interim applications,
is taken on record subject to cost of Rs.10,000/- to be paid to the
applicant within one month from today. If respondent failed in it,
respondent shall take note that judgment will be pronounced on next date.

2. Today respondent appeared with his advocate and filed both these
documents, named as reply to interim and main application. This court,
tried to made understood to Ld. Advocate Smt. N. Q. Shaikh, that matter
is fixed for final arguments and also brought to notice the ex-parte order.

3. But she is not in a position to listen and submitted that whatever it
