3. Particulars of Offence :- That you accused on 29/12/2023,
In between 23.40 to 23.50 hours, at Murgan Chawl, 15th Road,
Santacruz (W), Mumbai were found consuming
ganja and
thereby committed an offence punishable 8 (c), 27 of N.D.P.S.
Act.
Particulars are read over & explained to accused in vernacular.
The accused pleaded guilty voluntarily. Plea of the accused is as below.

Q. 2 :- Have you received copy of the Charge-sheet ?
Ans :- Yes

JUDGMENT
The accused is produced today through the video
conferencing mode. The accused pleaded guilty voluntarily. Hence, his
plea is accepted and he is held guilty for the said offence. Heard, the
accused on the point of sentence. He pray leniency. Lenient view is
taken, as family of accused depends on him. The record shows that, the
accused is judicial custody since 30/12/2023.

2. It seems that, he is in judicial custody near about 12
(Twelve) days. Therefore, considering the facts of the case I am of
opinion that, period already undergone by the accused in the judicial
custody is sufficient punishment to him. Hence, I proceed to pass the
following order :-
ORDER
1 The accused viz. Mithun Ramesh Burman is convicted
for the offence punishable under section 8 (c), 27 of
N.D.P.S. Act vide section 252 of Criminal Procedure
Code and he is sentenced for the period already
undergone by him in judicial custody.
2 The accused be given benefit of set off as per section
428 Criminal Procedure Code.
3 Copy be given to the accused free of cost.
