IN C. R. NO.28/2025 OF VAKOLA POLICE STATION
Accused have filed present applications for enlarging them
on bail. According to accused, they are alleged to have committed an
offense punishable under sections 309(6), 3(5) of B.N.S. They
submitted that, they have not committed any offense, as alleged. They
are falsely implicated in the present crime. It is contended that, They
are permanent resident of Mumbai. They will not abscond. Lastly, They
prayed that, applications be allowed and They be released on bail.
2. Ld. A.P.P. and the investigating officer have resisted the
prayer of granting of bail to the applicant accused, contending that, the
offense is serious one. Allegations are well founded. The accused have
committed robbery and caused injury to informant. If accused released
on bail, they will be absconded. Lastly, they prayed that, application be
rejected.
3. Heard Ld. Advocates appearing on behalf of accused
persons and Ld. APP Joshi for the state.
4. I have gone through record. The FIR shows that accused
alleged to have robbed the informant and caused injury the record
further shows that almost the stolen property has been recovered. All
accused are resident of Mumbai. Further the investigation for which the
custody of accused was required, has been completed. Though offence
is non bailable but triable by this Court. The presence of accused can be
secured through surety. Hence, by imposing conditions accused can be
released on bail. Hence, I proceed to pass following order.

ORDER
1 Applications are allowed.
2. Accused no 1 to 4 be released on P. R. and S. B. of I.10,000/-
each.
3. The accused shall not tamper the prosecution evidence.
4. Accused shall remain present in police station Vakola on each
Monday at around 11.00am to 01.00 pm till filling the
chargesheet.
5. Accused provisionally be released on cash bail of Rs.10,000/-
each and they shall furnish the surety within 4 weeks from the
date of released from the jail.
