ORDER BELOW BAIL APPLICATION NO.1009/2022
1. Perused record. Heard both the sides.
2. This shabbily hand written bail application filed in this matter
wherein serious allegations of recording videos of the informant and their
dissemination were made mentioning that investigation is over, offence is
triable by this court itself, accused is permanent resident of India and have
no any antecedents. Ld. A.P.P. objected to it stating that there found
involvement of the accused in the alleged acts. There is possibility of
tampering. Therefore, application shall be rejected.
3. Accused is in custody since 04.12.2021. Investigation is over. On
perusal of final report it is noticed that material now produced is little bit
deficient. Considering this aspect, reasons assigned needs due
consideration though not properly drafted. Further commencement of trial
and its conclusion will take substantial time. Offence is triable by this
court itself. These aspects also reserves some weight. Accordingly,
following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.30,000/-. Permission granted to deposit cash surety instead of
furnishing surety bond or furnishing one or more sureties for the amount
ordered.
c. Accused person shall furnish his detail address and proof thereof
and shall not came in touch with informant in any way and shall not
tamper with the prosecution evidence.
