ORDER BELOW APPLICATION NO. 105/N/2020 ARISING OUT OF
C.C.NO.1321/PW/2019 REGISTERED WITH VAKOLA POLICE STATION
1. The present application is filed by the applicant/accused
Sukbirsingh Gupta for no objection for renewal Aerodrome Entry pass
which is to be issued by Bureau of Civil Aviation and Security.
2. The I.O. prayed for appropriate order. The APP opposed the
application.
3. The applicant submitted that he is working as senior
Superintendent Service Engineer with line Maintenance Division of
Engineering Department of Air India. He is required to enter Airport
Apron Area and Workshops and for that purpose he requires Aerodrome
Entry pass. Bureau of Civil Aviation and Security issues AEP to service
engineers. His AEP has expired on 31.12.2019. He is praying for No
Objection for issuance of said pass by Bureau of Civil Aviation and
Security. He has informed Bureau of Civil Aviation and Security about
pendency of above mentioned cases against him. However, he could not
produce on record any circular or notification issued by Government or
said department requiring noobjection from the court for issuance of AEP.
Rather it is an internal administrative matter of the said authority. The
applicant could not satisfy about the necessity for noobjection as prayed.
The concerned authority is at liberty to deal with the application of the
applicant for issuance of AEP on its own merit. It will not be proper to
interfere in the internal administrative affairs of the said authority. Hence,
the application is rejected.
