ORDER BELOW APPLICATION FOR RETURN OF PROPERTY IN
C. C.NO.103/N/2019 ARISING OUT OF C.C.NO.197/PW/2019 OF BKC
POLICE STATION.
1. The applicant Shahrukh Ibrahim Shaikh filed this application for
return of property i.e. passport bearing no. R1164217 seized by BKC Police
station in CR No. 321/2018 registered u/sec. 420, 465, 468, 471, 473, 120B
of IPC.
2. The APP opposed the application.
3. On perusal of the chargesheet, it appears that there is reference
of seizure of passport bearing no. R1164217. The applicant submits that he
is entitled for return of his passport. He has produced on record photocopy of
his passport. On perusal of the said copy, it appears that the said passport is
of the applicant. As the chargesheet is filed, the passport is not required for
any further purpose. Keeping the passport in custody of the police station for
further period is not necessary. Thus, it will be proper to return the same to
the applicant. He is ready to abide by the conditions that may be imposed on
him. In the result, following order is passed:
ORDER
1. The application is allowed.
2. The custody of passport bearing no. R1164217 seized by BKC Police
station in CR No. 321/2018 registered u/sec. 420, 465, 468, 471, 473,
120B of IPC , be handed over to the applicant.
3. The applicant is directed to produce the said passport as and when
required by this court for perusal.
4. The applicant should obtain prior permission of this court before
traveling abroad.
