ORDER BELOW EXH1
The Medical Officer of Regional Medical Hospital, Thane
sought reception order of the mentally ill person namely, Ahmed Ajij
Shaikh alongwith medical expenses of said ill person in true copy
applications. The medical officer examined said ill person and
submitted report alongwith letter stating that said ill person is in
requirement of further treatment. For which, they require reception
order of said illperson.
As per requisition, he can be admitted in the Regional
Medical Hospital, Thane, if this court pass reception order.
As per section 102 of the Mental Health Care Act, 2017,
this court can convey the person suffering from mental illness to the
Public Mental Health Establishment for assessment and treatment, if
necessary. The Mental Health Establishment there upon, shall deal with
such person in accordance with the provision of the Act. The assessment
of mental illness being already done, it is not necessary to direct further
inquiry as to assessment of mental illness. It is submitted at bar that no
crime is pending against said illperson. Hence order :

ORDER
1. The Superintendent Regional Mental Hospital, Thane is hereby
directed to accept mentally ill person namely, Ahmed Ajij Shaikh U/sec
102 (1)(a) of Mental Health Act, 2017 for required treatment as per the
provisions of said Act.
2. Issue directions to the Superintendent/ Chief Medical officer of
Regional Mental Hospital, Thane.
3. Ahmed Ajij Shaikh shall be taken by Kherwadi Police to the
Mental Hospital Thane forthwith for treatments.
4. The Superintendent / Chief Medical officer may file periodical
reports about the progress of the patient.
5. The Kherwadi Police is directed to deposit maintenance charges
as per government fee.
6. The patient may be discharged by the Chief Medical officer after
completion of treatment.
