ORDER BELOW APPLICATION AT EXH.22
This is an application for substitution of Power of Attorney
Holder of complainant on the ground of illness and age. It is contended
that the complainant has suffered stroke, swallowing problem and
unable to approach to the court.
2. The application is supported with the medical certificate
and other medical record relating to the original complainant.
3. Heard both the sides.
4. The reason of substitution for the Power of Attorney in
complaint of the complainant appears genuine one. After all it is upto
the complainant to prove his case. The burden of proving case is on
complainant. It may be proved through Power of Attorney, if he is
acquainted with the facts. The advocate for the accused objected for the
substitution. There is no prejudice causing to the accused if the
substitution is allowed. I do not find merit in his objection. The accused
had ample opportunity of cross examination. Hence I pass following
order.
O R D E R
1) The application is allowed.
2) The complainant is allowed to substitute Power of

3) The complainant to do the needful within 15 days.
