ORDER
1. This is an application filed by the applicant/accused viz. Nikhil
Gupta for the permission of this court to travel 1) Turkey and Europe from
15/02/2025 to 15/02/2026, 2) Toronto, Canada from 15/05/2025 to
20/06/2025 3) USA 24/05/2025 to 10/06/2025 for work purpose.
2. The Investigating Officer and Ld. APP opposed the application
by contending that, the offence against accused is serious in nature and
presence of accused is required for trial.
3. The accused/applicant assured that, he will appear before the
Court whenever he is directed to remain present. He has produced
documents in support of his submission. Thus it will be proper to grant
permission to the applicant/accused to travel abroad during said period. It
is imperative to impose conditions on him so that, proceeding of the case is
not hampered in any way. It is noticed that some conditions were imposed
on the applicant/accused, while granting anticipatory bail. The accused is
obliged to comply with the said conditions including obtaining permission
of the said court. Thus, in view of the situation, it will be proper to allow
the application subject to conditions. In the result, following order is
passed :-

ORDER
1. The application is allowed subject to following conditions-
(i) No-objection is granted to the accused/applicant viz. Nikhil
Gupta to travel 1) Turkey and Europe from 15/02/2025 to
15/02/2026, 2) Toronto, Canada from 15/05/2025 to
20/06/2025 3) USA 24/05/2025 to 10/06/2025, for work
purpose.
(ii) The applicant /accused should obtain permission from Hon'ble
Sessions Court to travel abroad, as per the conditions in
Anticipatory bail or the condition imposed by any higher court
in this regard, as the case may be.
(iii) The applicant/accused should report to this court within 15
days of his return and produce copy of his boarding pass and
passport to show that, he actually traveled on aforesaid period.
(iv) In case of breach of above conditions permission will be treated
as withdrawn.
(v) The applicant/accused to complete necessary formalities and
this permission shall not be deemed to be an alternative to any
rules or regulations which the applicant/accused is obliged to
comply with.
3. Issue letter accordingly to the concerned authority.
