ORDER BELOW EXH. 1
1. Perused record. Heard both the sides.
2. This is an application under Section 480 of Bhartiya Nagrik Suraksha
Sanhita (B.N.S.S.), for bail. Accused prayed for bail mainly on the ground
that she is poor and innocent. Investigation relating to her is over. The
allegations are false. She is suffering from various ailments. She is ready to
remain abide by the conditions, if any, imposed, etc. Investigating Officer
and Ld. A.P.P. objected to it stating that investigation is in progress and
there is possibility of tampering. There is sufficient material to implicate the
accused, etc.
3. Accused is in custody for sufficient time. The relevant evidence
already seems to be collected. Investigation relating to accused is over. The
various documents produced by accused, particularly Birth Certificate,
Aadhar Card, Election I.D. Card, PAN Card, Ration Card, etc. supports the
contention of the accused that she is Indian resident. The possibility of
absconding or tampering is almost nil. Offence is triable by this Court itself.
Accused is ready to remain abide by the conditions. She is resident of place
situated within the jurisdiction of this court itself. The conclusion of
investigation, filing of charge-sheet and consequent conclusion of trial will
take much time. Accused is ready to remain abide by the conditions, if any,
imposed. Considering reasons mentioned, say of the Investigating Officer
and Ld. A.P.P., and above aspects of the matter, following order.
ORDER
Application is allowed and accused is released on bail on her
furnishing P.B. and S.B. of Rs.15,000/-. Permission granted to deposit cash
surety instead of surety bond.
