ORDER BELOW EXH.1
1. Today the accused appeared before this court through video
conferencing. The accused pleaded guilty to the offence. His plea is
voluntary as despite giving clear understanding to him about the effect of
punishment, he has pleaded guilty to the offence. Plea accepted.
2. Heard Ld. A.P.P. and accused on the point of sentence. Ld. A.P.P.
prays for severe punishment. However, accused prayed for leniency.
Accused is in custody since 28.12.2024. Accused had stolen the gear
cycle, of value of Rs.30,000/- and he is in jail for more than one month.
He is poor and offence are not much serious. Therefore, considering the
nature of offence and his prayer, following order :
ORDER
A. The accused Mohd. Adil Salim Shaikh, is convicted under Section
264 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for an offence
punishable under Section 303(2) of Bhartiya Nyay Sanhita, 2023, and
sentenced to suffer simple imprisonment for one month.
B. Accused Mohd. Adil Salim Shaikh, is entitled to set off as per
Section 468 of the Bhartiya Nagarik Suraksha Sanhita, 2023. As accused
is in jail since 28.12.2024, the punishment has already been undergone by
him, therefore, he shall be released forthwith if not required in any other
offence.
C. The property seized already returned to the informant.
D. Copy of this order to be given free of cost to the accused.
