Order Below Bail Application
Perused bail application and say. Heard both side. Informant has
not filed his say. Accused Mr. Urmit Rakeshkumar Singh is charged for
the offence punishable U/Secs.318(4), 319(2), 336(2), 336(3), 338,
340(2), 61 of the BNS and Section 66-D of Information Technology Act.
Prosecution alleged that, accused along with co-accused have cheated
the informant and misappropriated Rs.2,85,73,718/-. Accused has
provided his bank account on commission basis to co-accused and out
of fraud amount Rs.11,21,000/- is transferred to his account. He has
withdraw said amount by cheque as commission for the said
transaction. It is cyber fraud. Amount is huge. Investigation is not over.
It is in progress. Offence is non-bailable. Therefore, considering the
nature of offence, the accused is not entitle to enlarge on bail.
Accordingly, I proceed to pass the following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
