This application is filed by the applicant namely Satish Shantilal
Chheda for release of motorcycle bearing No.MH02FM3410, which is seized
by the Excise Department in connection with Crime No.1/2022 registered with
the Excise Department for the offence punishable under section 65(A), 81, 83
of Bombay Prohibition Act.
2) Say was called from I. O. and A.P.P. They both have strong
objection and submitted that it is used for transportation of liquor and it is
essential at the time of trial. They both prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record xerox copies of invoice receipt, insurance paper & verified
copies of his Adhar card alongwith his affidavit. The applicant failed to file
verified copy of RC book of motorcycle. Therefore, he is not entitled to get the
custody of the vehicle. Under such circumstances, I pass following order :
