ORDER BELOW EXH.1
1. On 20.02.2023, the accused appeared before jail court at M.C.P.
Arthur Road, Mumbai. The accused pleaded guilty to the offence.
2. He is totally made aware of the consequences of the pleading guilty
to the offence. Despite that he is ready to plead guilty. His plea is
voluntary.
3. The prosecution is that accused with intention to extort money
caused hurt to the informant Mr. Sufiyan and threatened his family
members. Heard his Ld. Advocate on the point of sentence. Accused is in
jail since 21.11.2022. He prayed for leniency mainly on the grounds of
dependency and poverty. There is substance in the contentions as nobody
approached for bail compliance on his behalf since long though bail is
granted during remand proceedings. Further, allegations are not much
serious. Considering the nature of offence and the period undergone by
the accused, following order:
ORDER
A. Accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Sections 327, 504 and
506(Part II) of Indian Penal Code.
B. Accused is sentenced to suffer rigorous imprisonment of three
months for each of the offence punishable under Sections 327 and
506(Part II) of Indian Penal Code.
C. Accused is sentenced to suffer simple imprisonment of one month
for the remaining offence punishable under Section 504 of Indian Penal
Code.
D. All these sentences shall run concurrently.
E. Accused is entitled to set off as per Section 428 of the Code of
Criminal Procedure. As accused is in jail since 21.11.2022, the major part
of punishment has already been undergone by him and shall be released

after undergoing punishment as ordered, if not required in any other
offence.
F. The property seized shall be disposed off as worthless.
G. Copy of this order to be given free of cost to the accused.
