ORDER BELOW EXH.01
Heard advocate for complainant. Accused and his advocate absent
since last so many dates. There is reason to believe that accused has no
case in defence and as such he is remaining absent and protracting the
trial. Already bail bond of the accused is forfeited vide order passed below
application at Exh.45. The matter is more than 5 years old. Neither
accused nor his advocate are remaining present for conducting trial.
Therefore, for the further progress of the trial, it is necessary to dispense
the statement of the accused to be recorded under section 313 of Code of
Criminal Procedure. Hence, I pass following order.
ORDER
1) In view of order passed below Application Exh.45 Bail
Bonds of accused stands forfeited. The amount of cash bail
of Rs.8,000/- deposited by the accused be credited to the
Government Account.
2) The statement of accused to be recorded under section 313
of Code of Criminal Procedure stands dispensed with.
3) Issue standing NBW against the accused.
4) Matter be posted for final arguments on next date.
5) Order dictated and pronounced in open court.
6) Order be uploaded on CIS for the knowledge of the parties.
