1. Perused record. Heard Ld. Advocate for the applicant.
2. The present application is filed under Section 145 of Code of
Criminal Procedure, contending that the possession of the property
mentioned in the application shall be handed over to the applicant. It is
clear from the facts came on record that there is dispute about the claim,
title and possession of the property. The allegations purely constitutes
dispute of civil nature based on decision of property rights and other facts.
The power entrusted with this court under Section 145 of Code of
Criminal Procedure, are restricted and this court has no jurisdiction to
decide the issues exclusively covered by jurisdiction of Civil Court.
Therefore, prayer granted can not be allowed. Accordingly, following
order -
ORDER
Application is rejected.
