Particulars of offence :
That you accused on 25/09/2019 at about 17.30 hours at Ashiana Building
corner Phoot path. Near Hinduja Hospital, Bombay scottish School gate no.2, Veer
Sawarkar Marg, Mahim (W) Mumbai 16. in furtherance of your common intention, found
using Pot of Hukka for the purpose of serving to the customers i.e. combustible matter at
open public place knowingly or negligently omitted to take such order as sufficient to guard
against the probable danger to human life from any such fire or other combustible material,
and thereby committed an offence punishable U/Sec.285 of IPC within my cognizance.

Accused voluntarily pleaded guilty to the offence with which he has been
charged and requested for leniency. He has also submitted a written application pleading
guilty to the charge. His plea being voluntarily one, I accept the same and convict him for
the offence with which he has been charged. Considering the nature of the offence, I pass
following order :
ORDER
Accused 1. Ramdas Nandkumar Surve , is convicted U/Sec.252 of Cr.P.C. for
the offence punishable U/Sec.285 of the IPC and sentenced to suffer S.I. till rising of the
Court and to pay a fine of Rs.1,000/ (Rupees One Thousand only), in default of payment
of fine, accused to suffer S.I. for 7 (seven) days.
Copy of the order be given to the accused free of cost.
Case to proceed against remaining accused.
