ORDER BELOW EXH.1
1. The applicant/accused, in C.R. No.81/2024 registered with
West Regional Cyber Police Station, B.K.C., Mumbai, has filed this
application to defreeze his bank account No.5905502178 ICICI Bank,
Branch Civil Lines, Nagpur Branch. Perused application, say of Ld. A.P.P.
I.O. failed to file his say. Heard Ld. Advocate for applicant and Ld. A.P.P.
2. It appears that the accused has cheated the informant and his
family members and misappropriated Rs.5,65,77,003/-. Out of it
Rs.9,00,000/- is transferred to the account of applicant. Ld. A.P.P. has
submitted that to defreeze his account by keeping lien/put on hold of
amount Rs.9,00,000/-. If said account is not defreezed, it will remain
unused and the applicant will suffer irreparable loss. Said account can be
defreezed on a condition that Rs.9,00,000/- credited to his account shall
be kept as lien or put on hold. Accordingly, I proceed to pass the
following order -
ORDER
a. The application is allowed in following term -
b. The account No. 5905502178, Branch Civil Lines, Nagpur,
ICICI Bank account of applicant/accused is defreeze and permitted to
operate subject to condition that the amount Rs.9,00,000/- shall be keep
as lien and put on hold until further order.
