ORDER BELOW EXH.1
1. Perused record, verification of the complainant and heard learned
advocate for him.
2. It is the case of the complainant that he worked in Saudi Arabia, then
solemnized marriage in India with Accused No.1, Smt. Seema Khatoon. From
money earned there he purchased property in her name. Later on disputes
erupted leading to filing of proceedings by her before Family Court, which
compelled complainant to leave Saudi Arabia. He came back to India and now
facing those proceedings. In 2018, he obtained certain documents during
proceeding of his claim before Family Court and came to know for
concealment of payments made by him for purchasing property the accused
persons forged certain documents.
3. Therefore, complainant approached this court and file this complaint. In
the backdrop of above allegations.
4. On perusal of complaint, verification and other documents on record it
appears that there occurred some financial transactions between parties, but
being spouses this is but natural. Therefore, there requires concrete pleadings
and additional corroborating evidence in support of such pleading to constitute
prima facie case to proceed further.
5. If we perused whole record the allegations are somewhat vague. The
verification clearly reflect that there is something otherwise for which the
present complaint is filed. The whole transaction if accepted as it is it can not
be said to be a transaction of nature which will attract criminal liability, at the
most it is a case of civil liability. No offence made out. Therefore, following
order -
ORDER
Complaint is dismissed.
