COMMITTAL ORDER
Accused No.1 to 6 are produced before the Court through video
conferencing. They are in Jail. They are charged with the offence punishable
under section 307, 323, 341, 343, 143, 144, 147, 148, 149, 34 of IPC r.w.
Section 4, 25 of Indian Arms Act r.w. Section
37 (1) (a), 135 Maharashtra Police Act. The offence punishable under
section 307 of Indian Penal Code is exclusively triable by the Hon'ble Court
of Sessions. The copies of police report and other documents as specified in
section 207 of the Code of Criminal Procedure have been supplied to the
accused. The case will have to be committed to the Hon'ble Court of Sessions
in view of nature of offence. Hence, the following order :-
O R D E R
1. The case is hereby committed to the Hon'ble Court of Sessions.
2. Accused is remanded to Magisterial Custody until commitment of the
case and also during and until the conclusion of trial before the Hon'ble Court
of Session vide section 209 (a) (b) of the Code of Criminal Procedure.

3. The Jail Authorities is directed to produce the accused before the
Hon'ble Court of Session on 27.01.2023 on receiving production warrants
from that Court in Form No. IV, Chapter XXXIII of the Criminal Manual.
4. The record of the case, the documents and articles, which are to be
produced in evidence, shall be sent to the Hon'ble Court of Sessions.
6. The Police Station Officer, Police Station Khar is directed to produce
muddemal property, in the Hon'ble Court of Session on or before 27.01.2023.
7. The Public Prosecutor shall be notified of the commitment of the case to
the Hon'ble Court of Sessions.
