The complainant and advocate absent for so many dates.
The case is pending since year 2020. No steps taken to secure presence
of accused despite passing specific order dated 18.07.2024. Keeping the
file pending years together without proceeding further taking
appropriate steps by the complainant is unjustified.
2. Considering the year of the case there is reason to believe
that complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused are acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
