ORDER BELOW EXH.48
1. Applicant/informant has filed this application to deliver the cash
deposited in court by the accused and seized cash by the I.O. mentioned
in the application and as per say of I.O. to him on any conditions.
Perused application and say of I.O. and Ld. A.P.P. Heard both sides. The
I.O. have no objection to deliver the seized property to the applicant on
conditions. Advocate for accused Prashant and Manisha filed reply
below Exh.42, they have objection, but orally submitted that, it may be
returned. Hence, order:
ORDER
1. The seized property i.e. cash Rs.13,23,000/- deposited in court
and cash Rs.2,61,500/- seized by the I.O. be delivered to
applicant on executing supurtnama (indemnity bond) of same
amount before the I.O. on the following conditions namely:
2. Investigating officer is directed to take appropriate colour
photographs of the seized property and to prepare panchanama
of the same before handing over it in favour of the applicant
and further directed to produce the panchnama, photographs
and supurtnama before the Court and attach in main court case.
3. Present proceeding be merged in the main proceeding.
