Cross examination of CW-01- Mr. Vinod Jaising by advocate Ms.
Shradha Singh for the accused :
15. I am involved in a business Renting Properties. I am
Property Consultant. It is true to say that I have not mentioned my
occupation as to a Property Consultant and Renting Property Business
in my notice, complaint and affidavit in lieu of Examination in Chief. I
am knowing accused since year 2017 that is prior to the year of
transaction. I met her in somebodies office. There are two partners in
our Partnership Firm. Myself and Mr. Prakash are the partners. The
Partnership Firm is registered Partnership Firm. It is true to say that I
have not produced any document as to the Partnership Firm. As it is not
my business to lend money, I do not possess money lending licence. It is
not true to say that I am rather my firm is carrying out illegal money
lending business without any licence. It is not true to say that I am
charging heavy interest by the illegal money lending business. It is not
true to say that under guise of friendly loan myself and our firm is
carrying on illegal money lending business. It is true to say that there is
no loan agreement executed in between me and accused for said
friendly loan. Witness volunteers that accused has issued a letter to that
effect in my favour. It is true to say that I have not produced the letter
issued by accused on record. It is not true to say that no such letter was
ever executed by the accused in my favour at any point of time and as

such I have not produced it on record. It is true to say that I have not
mentioned as to issuing letter by the accused in my favour pertaining to
loan in statutory notice dated 16.12.2019. It is not true to say that no
such loan was ever given by me to the accused.
On oral request of the advocate for the accused cross
examination is deferred till next date.

16. It is true to say that in paragraph No.4 of demand notice
Exh.23 I have stated that accused agreed in principal to pledge the flat
to my client. It is true to say that I do not possess licence or permission
to pledge the flat and charge interest on it. It is true to say that there is
no Mortgage Deed or Deed of Pledge in between me and accused. It is
not true to say that I am carrying money lending business illegally
without liecence. It is not true to say that disputed cheque was given to
me by the accused only for the purpose of security and it was not to be
deposited.
17. It is not true to say that I am not the partner of
complainant firm M/s. Prakash Vinod and Company. It is not true to say
that I do not have authority to file the complaint or depose on behalf of

complainant. It is not true to say that I am deposing false on oath. It is
not true to say that I have filed false case to extort money from the
accused. It is not true to say that accused has no liability to pay any
amount to the complainant.
