ORDER BELOW EXH.1
1. Perused record. Heard both the sides.
2. Investigating Officer has no objection to handover the custody of
vehicle. Ld. APP objected to it stating that the property is required for
identification. There is no substance in the objection raised. Vehicle is
languishing in the police station since long back. If it is allowed to
remain there it will definitely damage. Considering these aspects,
reasons assigned in the application and as from the record it is clear
that applicant is bonafide claimant of the property, following order
ORDER
a. Application is allowed.
b. PSO concerned police station is directed to handover the
custody of the vehicle Toyota Etios bearing registration
no. MH04FA3683, after verifying documents of
ownership and on his executing indemnity bond of
Rs.5,00,000/ before him.
c. Copy of this order shall be sent to concerned police station
for compliance.
