Application for Return of Property
1. Read the application. The applicant / informant claimed that she
has lodged the report in Khar police station for the offence punishable
U/sec.379 of IPC and crime No.805/19 is registered. She claimed that
her mobile Real Me X Popup Generation was stolen and during
investigation police recovered the same and prayed to return the same.
2. Ld. APP filed the say underneath the application and submitted
that property is required for identification during trial and accordingly
conditions may be imposed. I.O. may also directed to obtain
photographs, and to prepare panchanama of the property. I.O. filed the
say and submitted that the property is recovered and he has no
objection to return the said property. Accused also given no objection
to return the said property.
3. Heard the Ld. Counsel for the applicant. In the affidavit, applicant
has submitted that she is the owner of the mobile Real Me X Popup
Generation and she has produced copy of Tax Invoice in respect of that
on record. Report is lodged by the applicant and nobody has claimed
the property. Hence, on the conditions, interim custody is given to the
applicant. Hence, I pass the following order :
O R D E R
i] Application is allowed.
Ii] The Inspector of Khar Police Station, shall hand over the mobile
Real Me X Pop – up Generation to the present applicant subject to

Indemnity Bond for Rs.20,000/ (Rupees Twenty Thousand Only)
undertaking to the effect that,
(a) she will not alienate, destroy, give on rent or part with the
possession of the above mobile,
(b) she will produce the said mobile phone before the Police
Station or the Court as directed by this Court.
(c) That the applicant to furnish photographs of the mobile phone to
the police station, which later on to be filed alongwith the final report
in the Court by the police.
