ORDER BELOW EXH.1
The applicant/accused Mohammad Amjad Khan has filed
this application for permission to travel to Svobodny, Russia for job
purpose from 07.02.2026 to 07.01.2027. Perused application and say of
Ld. A.P.P. and I.O. They objected it. Perused documents. Heard Ld.
Advocate for applicant and Ld. A.P.P.
2) According to applicant, he is facing trial for offence
punishable under Sections 354, 506 of IPC and Section 67 of I. T. Act in
connection with FIR No.87/2024 registered at Bandra Police Station. It
will take time to conclude the trial. The applicant/accused has filed his
affidavit and copies of order dated 24.11.2025, the employment
contract dated 21.04.2023, copy of the screenshot dated 07.01.2026
along with email dated 06.01.2026 and VISA.
3) Charge sheet is filed on 05.11.2024. Next date of this case
is 16.07.2026. Though the applicant is accused, he has right to travel
abroad. The applicant is returning to India on or before 07.01.2027. His
personal liberty cannot be curtailed by rejecting the application. His
absence during said period will not obstruct the trial. Considering the
long period of his traveling to abroad, to secure his presence the
condition to deposit the amount shall be impose. Hence, present
application needs to be allowed. Thus, I proceed to pass following
order:

1) Application is allowed subject to condition that he shall deposit
cash security of Rs.2,00,000/- (Rs. Two Lakhs only) till the period he
return to India.
2) Applicant/accused shall intimate the Court soon after his arrival
at India.
3) Applicant/accused shall furnish detailed itinerary.
4) After his arrival in India he can withdraw above cash security.
