Perused bail application and say. Heard Ld. A.P.P., Ld. Advocate
for accused and Ld. Advocate for informant. Accused Mr. Ramji Mandan
Vaid charged for the offence punishable U/Secs.318(4), 349, 3(5) of
BNS. Prosecution alleged that, accused has cheated the informant and
other victim by mortgaging fake gold and obtained Rs.10,00,000/- from
both. Informant has filed application and submitted that he has no
objection to grant the bail as he has received his fraud amount of
Rs.4,00,000/-. Victim has objected to grant the bail as he has not
received his fraud amount of Rs.6,00,000/-. Investigation is not over. It
is in progress. Offence is non-bailable. Therefore, considering the nature
of offence, the accused is not entitle to enlarge on bail. Accordingly, I
proceed to pass the following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
