REASONS
The accused are produced before me. Charge is framed against
them, to which they voluntarily pleaded guilty. Accused are in jail custody
since 05.12.2019. Heard accused in person. They submitted that lenient
view may be taken as they are only earning members in their families.
Considering the nature of offence, circumstances under which it is
committed, antecedents of the accused, their age and the period of
detention already undergone, I proceed to pass following order :
ORDER
i) Accused Abdul Rehman Kamrujama Ansari and Ganesh
Madialgan Harijan convicted vide section 241 of Criminal
Procedure Code for the offence punishable u/sec. 380 r/w 34
of Indian Penal Code. They are sentenced to suffer R.I. for
4 months each and fine of Rs. 1000/ each, in default of
payment of fine, they shall undergo further R.I. for 1 month
each.
ii) The accused are in custody since 05.12.2019. They are entitled
to get benefit of set off for the period of detention already
undergone vide under section 428 of Cr.P.C.
iii) Muddemal property i.e. one Samsung J7 mobile phone be
returned to informant, as per law.
iv) Accused is already convicted in CC No. 58/PW/2020 &
81/PW/2020. They are sentenced to suffer imprisonment. Such
Previous sentence shall run concurrently with present sentence.
iv) Copy of this judgment be supplied to the accused free of cost.
