2. Heard accused and her advocate. Perused the photocopy of
UPI payment receipt for Rs.10,000/- dated 17.11.2023. She submitted
that due to death of her husband she could not pay the electricity bill
within time. Cheque was given towards security. Later on, she had paid
amount of outstanding electricity bill. She also shown me current
electricity bill dated 10.10.2025. Looking into all the documents and
absence of complainant and their advocate, there is reason to believe
that accused has paid the amount of disputed cheque.
3. No substance remains to keep the file as it is for trial in
absence of non existence of legal liability. Rather it would be an
harassment for a poor lady to attend the dates of the court. Had it
been not so, complainant, its authorized representative or advocate
would have remained present and taken appropriate steps. Hence, I
pass following order.
ORDER
1. In view of payment made by the accused and absence of
complainant, complaint stands dismissed under section
256(1) of Code of Criminal Procedure.
2. Warrants issued against accused stands cancelled.

3. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
