ORDER BELOW APPLICATION FOR REGISTRATION OF BIRTH
1] This is an application filed by applicant Nazeera Mohammed Iqbal
Kapadia with contention that her daughter Yasmin Mohammed Iqbal was born
on 02/10/1983 at above mentioned address i.e. at home. Due to unaware of
legal proceedings birth of her daughter could not get registered with concern
BMC authorities within the stipulated period.
2] The respondent i.e. Medical Officer of Health, H/West Ward,
Bandra W, Mumbai has filed report and submitted that the birth of Yasmin
Mohammed Iqbal born on 02/10/1983 is not registered with this office. He
further submitted that to scrutinize the proposal and necessary order be passed.
3] Alongwith this application the applicant has filed on record her
affidavit stating every facts as per her application and enclosed photocopies of
SSC statement of marks, HSC certificate, HSC statement of marks, College
leaving certificate, Degree certificate, passport etc. of the daughter of applicant.

4] On perusing the application, affidavit, documents of the applicant
in support of her application and report of BMC, this Court did not find any
hesitation to accept that 02/10/1983 is true and correct date of birth of
daughter of applicant. Hence, proceed to pass following order.
ORDER
1] The application is allowed.
2] The concern authority 'The Registrar, Birth and Death, H/West
Ward, Bandra (W), Mumbai – 400 050 is directed to take entry of the date of
birth i.e. 02/10/1983 (Second October Nineteen Eighty Three) of Yasmin
Mohammed Iqbal daughter of Mr. Iqbal Kapadia and Mrs. Nazira Mohammed
Iqbal Kapadia, in their register on accepting the fees as per the rules.
