ORDER IN C. C. NO.33/N/2020
1. The applicant is praying for return of amount of Rs.
6,89,720.60/ seized by Santacruz Police station in crime No. 425/2019,
registered u/sec.408 of IPC.
2. The Sr. PI of Santacruz Police station stated that he has no
objection to return the amount to the applicant. Notice was issued to the
accused. It was delivered to him. However, he did not bother to appear
and file his reply. It seems that he has no objection to the claim of the
applicant.
3. The applicant submitted that the accused who was his
employee, misappropriated the amount. He lodged report regarding the
incident. He has produced copy of FIR, PAN Card and Driving License in
support of his claim. No one else has claimed the custody of the amount. It
will be proper to hand over the amount to the applicant. In the result,
following order is passed :
ORDER
1. The amount of Rs. 6,89,720.60/ seized by Santacruz Police
station in crime No. 425/2019, registered u/sec.408 of IPC be
given to the applicant.
2. The applicant is directed to furnish indemnity bond of
Rs.7,00,000 /.

3. The applicant is directed to furnish said amount before the
Court, whenever required for trial.
