ORDER BELOW EXH.1
1. Today the accused Mr. Aman Imtiyaz Shaikh, is appeared before this
court through video conferencing. The accused pleaded guilty to the offence.
His plea is voluntary as despite giving clear understanding to him about the
effect of punishment, he has pleaded guilty to the offence. Plea accepted.
2. Heard him and Ld. A.P.P. on the point of sentence. He prayed for
leniency on the ground of poverty and compelling circumstances. Ld. A.P.P.
sought severe punishment. Accused is in custody since 25.12.2023. Accused
had stolen mobile phone of value of Rs.12,000/- and he is in jail since then.
Leniency needs to be shown in view of grounds assigned and stake involved.
Therefore, considering the nature of offence and his prayer, following order :
ORDER
A. The accused Mr. Aman Imtiyaz Shaikh, is convicted under Section 241
of the Code of Criminal Procedure, for an offence punishable under Section
379 of Indian Penal Code and Section 142 of Maharashtra Police Act and
sentenced to suffer simple imprisonment for one month for each of the
offences.
B. Both these sentences shall run concurrently.
C. Accused Mr. Aman Imtiyaz Shaikh, is entitled to set off as per Section
428 of the Code of Criminal Procedure. As he is in jail since 25.12.2023, he
shall be released after completion of sentence, if not required in any other
offence.
D. The property seized shall be handed over to informant.
E. Copy of this order to be given free of cost to the accused.
F. Inform Jail Authorities accordingly.
