Application for Return of Property
1. Read the application. The applicant / informant claimed that he
has lodged the report in Mahim police station for the offence
punishable U/sec. 454, 457, 380 of IPC and crime No.359/19 is
registered. He claimed that camera of Canon Company (5D) Model No.
DS126201 was stolen and during investigation police recovered the
same and prayed to return the same.
2. Ld. APP filed the say underneath the application and submitted
that property is required for identification during trial and accordingly
conditions may be imposed. I.O. may also directed to obtain
photographs, and to prepare panchanama of the property. I.O. filed the
say and submitted that the property is recovered and he has no
objection to return the said property on conditions.
3. Heard the Ld. Counsel for the applicant. In the affidavit, applicant
has submitted that he is the owner of the Canon Company Camera(5D)
Model No.DS126201 and bill in respect of purchase of said camera was
misplaced during the heavy flooding in July, 2018. Report is lodged by
applicant and nobody has claimed the property. Hence, on the
conditions, interim custody be given to the applicant. Hence, I pass the
following order :
O R D E R
The Inspector of Mahim Police Station, if in possession of the
Canon Company Camera (5D) Model No. DS126201 mentioned in the
application, shall hand over the same to the present applicant.

Before that the applicant to furnish Indemnity Bond for
Rs.1,50,000/ (Rupees One Lakh Fifty Thousand Only) undertaking to
the effect that,
(a) applicant will not alienate, destroy, give on rent or part with the
possession of the above camera,
(b) applicant will produce the said camera before the Police Station or
the Court as directed by this Court.
(c) That the applicant to furnish photographs of the camera to the
police station, which later on to be filed alongwith the final report in
the Court by the police.
