ORDER BELOW EXH.1
1. Perused record, heard learned advocate for the complainant.
2. Ld. Advocate for the complainant drawn attention towards the fact that
the crime is already registered with Bandra Police Station bearing C.R. No.533
of 2021, in respect of the present matter for offences punishable under Section
452, etc. of Indian Penal Code. He made request that as per Section 210 of
Code of Criminal Procedure the concerned police station directed to investigate
the aspect pleaded in this matter as well, as facts in issue are almost same and
inter related.
3. There is substance in the submissions made as the basis of these
allegations made in C. R. No.533 of 2021, are pleaded in this matter. Without
proof of these aspects the possibility of proof of allegations made in the said
C.R. is almost nil. The subject matter of inquiry and consequent trial is same.
Therefore, following order :
ORDER
a. The Investigating Officer of C. R. No.533 of 2021, registered with
Bandra Police Station, Mumbai, is herewith directed to investigate the
allegations made in the present complaint as well and file his report along with
the final report under Section 173 of Code of Criminal Procedure, going to be
filed in C.R. No.533 of 2021.
b. The copies of present record be sent to concerned police station for
compliance.
