ORDER BELOW BAIL APPLICATION, EXH.
1. Perused record. Heard both the sides.
2. This is an application under Section 437 of Code of Criminal
Procedure, for bail mainly on the grounds that applicant is not in any way
connected with the allegations. Investigation is over and there found no
role attributed to applicant that his account has been used by other
persons for transferring amounts. He is poor and there are dependents on
him. He is ready to remain abide by the conditions, if any, imposed, etc.
3. Ld. A.P.P. objected to it stating that amount involved is high and
there is possibility of tampering. Allegations are serious. Other accused
persons are yet to be arrested. There noticed involvement of the accused
in the allegations.
4. The summary of the allegations is that some unknown persons
approached informant and assured him of good returns for investment and
completion of tasks. Accordingly, informant paid Rs.26,56,667/-. Later
on he found himself duped. The record of investigation reflects that the
account of the present applicant/accused has been used for transferring
certain part of the whole amount. Except this there is nothing found
against the applicant/accused. There is doubt about his actual
involvement in the allegations.
5. Now the investigation is over and charge sheet has already been
filed. Accused is in custody since 17.10.2023. The evidence is of
electronic and documentary nature which is either seized or mainly in
custody of the third persons. As such possibility of tampering is almost
nil. Offence is triable by this Court itself. Accused is ready to remain
abide by the conditions. The other accused already released on bail. The
commencement and conclusion of trial will take much time. Considering
all these aspects and reasons assigned following order-

ORDER
a. Application is allowed.
b. Accused Mr. Bhagwan Kesar Singh, is released on bail on his
furnishing P.B. and S.B. of Rs.15,000/-. Permission granted to deposit
cash security instead of surety bond.
c. Accused person shall furnish his detail address and proof thereof.
