Application for Return of Property
1. Read the application. The applicant / informant claimed that he has lodged
the report in Mahim police station for the offence punishable U/sec.381 of IPC and
crime No.272/19 is registered. He claimed that property i.e. Steel Rods was stolen
and during investigation police recovered the same and prayed to return the same.
2. Ld. APP filed the say underneath the application and submitted that property
is required for identification during trial and accordingly conditions may be
imposed. I.O. may also directed to prepare panchanama of the property. I.O. filed
the say and submitted that the property is recovered and he has no objection to
return the said property. On behalf of accused Ld. Counsel filed Pursis for no
objection of accused in respect of return the said property.
3. Heard the Ld. Counsel for the applicant. In the affidavit, applicant has
submitted that he is the owner of the seized property i.e. Steel Rods and he has
produced copy of Challan and Tax Invoice in respect of that on record. Report is
lodged by the applicant and nobody has claimed the property. Hence, on the
conditions, interim custody is given to the applicant. Hence, I pass the following
order :

i] Application is allowed.
ii] The Inspector of Mahim Police Station, shall hand over the Steel Rods to
the present applicant subject to Indemnity Bond for

Rs.1,00,000/ (Rupees One Lakh Only) undertaking to the effect that,

(a) he will not alienate, destroy, give on rent or part with the
possession of the above Steel Rods,
(b) he will produce the said Steel Rods before the Police Station or
the Court as directed by this Court.
c) The applicant to furnish photographs of the Steel Rods to the police
station, which later on to be filed alongwith the final report in the Court by the
police.
