Applicant/ accused Mr. Vajid Hazrat Momin @ Wajid Hazrat Momeen has
filed present application for permission to go abroad to Saudi Arabia from
18/10/2025 to 31/10/2025 for the purpose of performing Umrah. It is submitted that
the accused was arrested by Malwani police station in C.R.No.380/2025 for the
offence registered u/secs.299, 302, 352, 196(1), 353(2) of BNS r/w section67, 45 of IT
Act and subsequently he was released on bail on 15/04/2025. It is further submitted
that the accused had applied and Haj Committee of India approved his name for Haj.
Accused is ready to face the trial. Applicant has filed copies of his Visa and Passport
and other relevant documents on record.
Considering the nature of offence, say of IO, in my opinion no prejudice
will be caused to any one, if the permission is granted to the applicant/accused to go to
abroad , on following conditions. Hence, I pass following order :
ORDER
1) The application is hereby allowed.
2) The applicant/accused Mr.Vajid Hazrat Momin @ Wajid Hazrat Momeen is
hereby permitted to go to abroad at Saudi Arabia from 18/10/2025 to 31/10/2025
for the purpose of performing Umrah.
3) The applicant/accused is further directed to submit undertaking and
report, when / after return to the court.
4) Previously, the applicant/accused has deposited amount of Rs.20,000/-,
same be considered for this application.
5) The applicant/accused is further directed to submit the copy of air tickets
and give the details of address with contact number where he is going to stay during
stay in abroad.
6) The Advocate of accused should present on due date for conducting trial
without any excuse and the accused shall not make any dispute about his identity and
no adjournment will be granted on the pretext of absence of accused.

7) The applicant/accused is further directed to come before the Court after
arrival in Mumbai. So also give details of his address, telephone/mobile number and
address of his communication for securing his presence.
