Applicant/ accused Smt.Manda Satyavan Shirke has filed present
application for permission to go abroad at United Kingdom to stay with her daughter
for delivery of baby from 24/10/2025 to 25/04/2026. It is submitted that chargesheet
has been filed against the accused vide C.C.No.4280/PS/2025 for the offence
punishable u/secs. 189(2), 329(4), 117(2), 115(2), 352, 351(2) of BNS
(C.R.No.66/2025) by Charkop Police Station. Accused is ready to face the trial.
Applicant has filed copies of her Passport and other relevant documents on record.
Considering the nature of offence in my opinion no prejudice will be
caused to any one, if the permission is granted to the applicant/accused to go to
abroad, on following conditions. Hence, I pass following order :
ORDER
1) The application is hereby allowed.
2) The applicant/accused Smt.Manda Satyavan Shirke is hereby permitted to
go to abroad at United Kingdom to stay with her daughter for delivery of baby from
24/10/2025 to 25/04/2026.
3) The applicant/accused is further directed to submit undertaking and
report, when / after return to the court.
4) The applicant/accused is further directed to deposit cash security of
Rs.10,000/- (Rs.Ten Thousand only).
5) The applicant/accused is further directed to submit the copy of air tickets
and give the details of address with contact number where she is going to stay during
stay in abroad.
6) The Advocate of accused should present on due date for conducting trial
without any excuse and the accused shall not make any dispute about her identity and
no adjournment will be granted on the pretext of absence of accused.
5) The applicant/accused is further directed to come before the Court after
arrival in Mumbai. So also give details of her address, telephone/mobile number and
address of her communication for securing her presence.
