IN C. R. No. 514/2025 OF SAMTANAGAR POLICE STATION

1. Present application is filed by Ld. Advocate for accused for releasing
accused viz. NImesh Dilip Darekar on bail, from the allegation of commission
of offence p/u/s 305-A, 3(5) of BNS.
2. It has been stated in the application that applicant/accused is innocent
and falsely implicated. He has not committed any crime as alleged. He is
innocent. He hails from respectable family. Hence, accused prayed to allow
the application.
3. Ld.APP has resisted the application stating that offence registered
against accused is serious in nature and non bailable. Property is yet to be
recovered. Investigation is in progress. If accused is released on bail, he may
abscond. Hence, APP prayed to reject the application.
4. Heard both sides. Offence is triable by this court. It will certainly take
time to conclude the trial. No purpose would be served by keeping the
accused behind the bars. Hence, I am of the opinion that the accused can be
enlarged on bail. Thus, I pass the following order.
O R D E R
1. Application is allowed.
2. Accused viz. Nimesh Dilip Darekar be released on execution of P.R. and
SB in the sum of Rs.15,000/-, with permanent residential and identity proof.
In alternative, accused be released on cash security of Rs. 10,000/-, subject to
furnishing surety of Rs. 15,000/- within 8 days.

3. Accused shall not indulge in criminal activity in future or he shall not
threaten the informant.
4. Accused shall not tamper with the prosecution evidence.
