ORDER BELOW APPLICATION FOR RENEWAL OF PASSPORT
Heard learned Advocate for the applicant as well as learned APP for
prosecution.
2. Applicant Mr. Dipesh Dashrathlal Shah, Age 54 years, r/o
Kandivali(W), Mumbai, made application seeking permission to renew his passport
No.K6310134 for the period of ten years.
3. Criminal case No.2099/PS/2017 for offences u/secs.288, 304A of IPC,
arising out of Crime no.210/2017, is pending against the applicant. The above
noted travel document i.e. Passport obtained by him (original produced for perusal)
was due for renewal on 07/10/2022.
4. In view of judgment of the Hon'ble Bombay High Court in case of
Roshan Lawrence Menezes v/s. Union of India & Ors., dated 7th August 2020, in Writ
Petition (lodging) no.699/2020, passport may be renewed and may be ordered to be
issued renewable after period of ten years. Considering the prayer, application
deserves to be allowed, as under :
1) The court has “No objection” for
consideration of renewal of passport held
by applicant Mr. Dipesh Dashrathlal Shah,
Age 54 years, r/o Kandivali(W), Mumbai,
for the period of ten years, by considering
requisite criteria.
2) The applicant is directed to file a copy
of renewed passport in the concerned
proceeding pending in the court.
3) Application is disposed of in above
terms.
