ORDER ON APPLICATION FOR RETURN OF PROPERTY
Perused 	Application, 	Report 	of 	Police, 	Affidavit 	of
Applicant, Copy of F.l.R. and Copy of Aadhar Card of Applicant.
C.R. No. 202/2026
BorivaliRailway Police Station, Mumbai
Police authority filed his say and stated that 	Police had
arrest accused namely Suraj Harilal Yadav @ Fullar in said matter and
after taking his personel search police found one gold chain weighting
10 	gram 	worth 	of 	Rs. 	65,000/-(Rs. 	Sixty-five 	Thousand 	Only).
Therefore police authority requested to 	imposed certain 	terms and
condition upon applicant and hand over said property to applicant.
A.P.P. filed his say and stated that the informantVapplicant filed his
report to the police station and police recovered said gold chain from
the 	custody 	of 	accused. 	Therefore 	imposed 	certain 	terms 	and
conditions upon applicant and passed necessary order. Accused in said
case has also filed his say and stated his 	no objection 	to hand over
property to applicant. Applicant Mangilal 	Devichand Rathod 	prima
facie appears to be the owner of the seized property. i.e. 	One Gold
Chain 	weighting 	10 	gram 	worth of Rs. 65,000/- (Rs. 	Sixty-five
Thousand Only).
Say of A.P.P., Concerned I.0. and Accused were called.
In the circumstances, the said seized property shall be
returned 	to 	Applicant 	Mangilal 	Devichand 	Rathod 	on 	executing
Supurtanama of 	Rs. 65,000/- (Rupees Sixty-Five Thousand 	only) on
stamp paper of Rs. 200/- before P.I. of concerned police station with

condition 	that 	he shall 	produce the 	said 	muddemal as 	and 	when
required by the Cout during the pendency of trial and not to change
it's nature, not to sell or exchange till final disposal of the case. I.O. to
file Supurtnama along with chargesheet and take photographs of the
said One Gold 	Chain weighting 10 	gram worth of Rs. 	65,000/
(Rs. Sixty-five Thousand Only) and submit it alongwith chargesheet.
